MOIT Guides Coordination on Consumer Rights Protection and Standard Contracts

The Ministry of Industry and Trade (MOIT) provides guidance on internal administrative procedures for coordination in protecting consumer rights regarding the control of standard form contracts and general transaction conditions.

On December 31, 2025, MOIT issued Circular No. 64/2025/TT-BCT guiding internal administrative procedures for coordination between state management agencies on consumer rights protection and sector-specific management agencies regarding the control of standard form contracts and general transaction conditions.

Legal Basis and Scope The Circular details internal administrative procedures for coordination as prescribed in Clause 4, Article 28 of Law No. 19/2023/QH15, based on the authority assigned in Clause 5, Article 28 of Law No. 19/2023/QH15 and Article 44 of Decree No. 146/2025/ND-CP.

Applicable Subjects:

  • State management agencies on consumer rights protection under MOIT.
  • People’s Committees of provinces and centrally-run cities.
  • Sector-specific management agencies (Sector Regulators).
  • Other relevant organizations and individuals.

Coordination Procedures According to ad-hoc requirements for consumer rights protection, the state management agency on consumer rights protection under MOIT may request sector-specific management agencies to coordinate by providing a list of business organizations/individuals applying standard form contracts and general transaction conditions in transactions with consumers.

Submission Methods: The implementation of the request is conducted via one of the following forms (quantity: 1 set sent to the sector management agency):

  • Direct submission.
  • Via post.
  • Online via electronic environment.

Dossier Components: A written request to provide the list of organizations/individuals using standard form contracts and general transaction conditions (according to Form No. 1 in the Appendix issued with this Circular).

Processing Sequence and Timeline:

  1. Request: The state management agency on consumer rights protection under MOIT prepares the dossier and sends it to the sector-specific management agency.
  2. Response: The sector-specific management agency receives the dossier and sends a written reply accompanied by the list of business organizations/individuals applying standard form contracts and general transaction conditions in their managed sector (according to Form No. 2 in the Appendix issued with this Circular).
  3. Deadline: Within 5 working days from the date of receiving the written request.

Sector-specific management agencies are responsible for coordinating to provide information on time and according to the content requested by the consumer protection agency under MOIT.

Local Implementation Based on the socio-economic situation and state management requirements for consumer rights protection locally, in necessary cases, Provincial People’s Committees shall consider formulating and issuing coordination regulations regarding the provision of lists of businesses using standard form contracts and general transaction conditions between the consumer protection agency and sector management agencies.

Effectiveness This Circular takes effect from December 31, 2025.
