MOIT Consults on CPTPP Used Car Quota Auction Amendments

Finalizing the Circular on Auction of Quotas for Imported Used Cars

The Ministry of Industry and Trade (MOIT) is collecting opinions on the Draft Circular amending and supplementing a number of articles of Circular No. 04/2020/TT-BCT regarding the auction of import tariff quotas for used automobiles.

MOIT is currently seeking public consultation for the Draft Circular amending and supplementing Circular No. 04/2020/TT-BCT (dated January 22, 2020) of the Minister of Industry and Trade. This Circular regulates the auction of import tariff quotas for used automobiles under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP).

Legal Basis According to the draft, the amending Circular is issued based on the regulations of the Law on Promulgation of Legislative Documents and relevant Government Decrees, upon the proposal of the Director General of the Agency of Foreign Trade.

Key Amendments and Supplements The Draft Circular focuses on amending and supplementing specific contents of Circular No. 04/2020/TT-BCT:

  • Proof of Origin (Article 5, Clause 2): The content regarding import dossiers is adjusted to use the specific terminology “proof of origin documents” (chứng từ chứng nhận xuất xứ) when carrying out import procedures for used automobiles.
  • Auction Principles (Article 6, Clause 1): The draft amends content related to auction principles by directing references to the “Law on Asset Auction” (pháp luật đấu giá tài sản).
  • Technical Specifications (Appendix I): In Appendix I issued with Circular No. 04/2020/TT-BCT, the draft adjusts the content regarding engine displacement to stipulate: “engine capacity > 3,000 cm³ (unit)”.

Effectiveness According to the draft:

  • The amending Circular will take effect from the date of signing.
  • It constitutes an inseparable part of Circular No. 04/2020/TT-BCT.
  • Simultaneously, it repeals Decision No. 731/QD-BCT dated March 4, 2020, of the Minister of Industry and Trade regarding the correction of Circular No. 04/2020/TT-BCT.
